Appeals Court Throws Out Obamacare Lawsuit Similar To House GOP Suit [TPM]

A federal appeals court threw out a lawsuit by a group of conservative doctors who sued the Obama administration for violating the Obamacare statute by delaying the employer mandate.

 

A three-judge panel on the 7th Circuit Court of Appeals on Friday unanimously affirmed a lower court decision that the Association of American Physicians and Surgeons lacked standing to sue because they failed to prove that the administration’s move would harm them.

 

“In a market economy everything is connected to everything else through the price system. To allow a long, intermediated chain of effects to establish standing is to abolish the standing requirement as a practical matter,” Judge Frank H. Easterbrook wrote for a three-judge panel of Republican appointees.

 

Notably, the lawsuit is similar to the one that the Republican-led House voted to authorize against Obama in July. GOP leaders say they plan to sue the president over the one-year delay of the employer mandate, although they’ve left some wiggle room to target another piece of Obamacare.

 

Legal experts say House Republicans will have a hard time achieving standing, which is required in order for the case to be heard on the merits. Their argument for standing is different, though, than the doctors’ claim: Republicans say Obama’s end-run around Congress threatens the separation of powers.

 

“The Supreme Court does not think that the Constitution’s structural features are open to litigation by persons who do not suffer particularized injuries,” Easterbrook wrote for the 7th Circuit panel.

 

The doctors association that brought the lawsuit said in 2011 its goal is “to fight socialized medicine and to fight the government takeover of medicine.” Prominent members have included former Rep. Ron Paul (R-TX) and current Rep. Tom Price (R-GA).

Remember Al Gore! He too distanced himself from Bill Clinton’s amazing Economic Record and he lost to George W Bush by 538 Votes. Had Al Gone not run away from one of the most prosperous times in American History, Economically, Florida would not have mattered anyway. Just imagine, Gore couldn’t even win his own home State.

 

We are living in an age where 70% of the Public cannot name the Three Branches of Government or even name one Member of The House of Representatives or Senate in their own State, but the Media and the Pollsters are betting the 2014 Mid Term outcome on Polls taken from these same people.

 

It seems self evident that phantasmagoric rationales and internecine narcissism far outweighs “facts,” at a time when the majority of Americans are uninformed, ignorant, easily brainwashed and yes, down-right stupid.

 

In a consolidation of Polls 72% of Americans agree that the Republican Congress hasn’t done anything to help the Middle Class, Poor, Student or our Veterans, but yet, 75% want Republicans to take control of the Senate and keep control of the House. Just how dumb have we become from the influence of Cable News and Social Media, where lies are trolled as facts; hate blinds reality; and a majority of Americans calls President Obama, dumb and stupid.

 

Imagine, a man that Graduated Magna Cum Laude from Harvard; taught Constitutional Law for twelve years and at 46, was elected President and reelected in 2012. A man that took America from the brink of collapse after eight years of Bush and Cheney meltdown and breathe life into America, yet he is disrespected and kicked around by the right-wing, some on the left and most in the Media.

 

One thing we have proven in America today by fulfilling the old adage; “Man is the only beast that runs faster when he has lost his way.”

If you’ve been following President Obama’s burst of enthusiasm for executive orders—I know it’s August, but hey, you’re reading this—you may have heard that he’s been flexing his muscle on behalf of labor. Last month,Obama banned federal contractors from discriminating against gay workers. For that one, he won liberal kudos and conservative scolding for refusing to exempt employers that object on religious grounds. Obama got similar attention for his order in January raising the minimum wage for new federal contractors to $10.10 an hour.

 

So it’s a little odd that the latest executive order in this bunch has gone virtually ignored (following a few dutiful daily news stories) even though it packs the biggest punch. “This is one of the most important positive steps for civil rights in the last 20 years,” Paul Bland, executive director of Public Justice, a public-interest law group, says of the July 31 order. The employer-side law firm Littler Mendelson calls it “the most sweeping order to date” that the Obama administration has aimed at federal contractors. The trade group Associated Builders and Contractors is “strongly opposed” and says the order could create a federal contractor “blacklist.”

 

What’s this about? Bear with me for a minute, because there’s a reason this one isn’t lighting up TV screens or Twitter. It’s important, but it’s also kind of technical. The order, called Fair Pay and Safe Workplaces, does two things. It requires companies bidding for federal contracts worth more than $500,000 to make previous violations of labor law public, if they have any to report. That’s a shaming device that the administration hopes will push companies to settle back wage claims and nudge them toward better behavior in the future.

 

The second part of the order is what Bland is so excited about. This provision says that companies with federal contracts worth more than $1 million can no longer force their employees out of court, and into arbitration, to settle accusations of workplace discrimination. “Here’s why this is so important,” Bland said when I asked him to explain. “For the last 20 years, the Supreme Court has been encouraging employers to force their workers into a system of arbitration that has been badly rigged against the workers. And so this order will result in millions of employees having their rights restored to them.”[Slate]

Speaker Boehner could help millions of Children, Women and Men if he would follow through and carry out his threat. It is written: “There is no greater love than to lay down your life for another,” if you follow through, think of  the millions you would have laid down your life for.

 

Suicide is intentionally causing one’s own death and is usually committed out of despair that may be attributed to a mental disorder such as depression, bipolar disorder, schizophrenia, borderline personality disorder, alcoholism, or drug abuse. Human beings in the modern era may also be driven to take their own life due to seemingly overwhelming stress factors such as the inability to cope with interpersonal relationships or financial difficulties.

 

 

Mental health experts are constantly making efforts to prevent suicides including limiting access to firearms, treating mental illness and drug misuse, and improving economic situations. For Speaker of the House John Boehner, it is the prospect of the government attempting to improve the economic situation of underpaid workers that drives him to consider suicide.

 

 

 

Boehner seriously wants Americans earning minimum wage to stay in poverty and has no plan to allow a vote on raising the minimum wage. When Boehner was head of the House Republican Conference in 1996, he said, “I’ll commit suicide before I vote on a clean minimum-wage bill” during an interview with the Weekly Standard. Four months later President Bill Clinton signed a minimum wage increase of 90 cents from $4.25 per hour to $5.15 despite Boehner’s objections and suicide threat even though the bill contained Republican demands for tax breaks for businesses. Boehner voted against another wage hike in 2007 when Democrats took over the House that raised the minimum to its current rate of $7.25.

LIBERALS ACCOMPLISHMENTS:

 

Liberals got women the right to vote! Liberals got African-Americans the right to vote! Liberals created Social Security and lifted millions of elderly out of Poverty. Liberals ended Segregation. Liberals passed the Civil Right Act; The Voting Right Act; Liberals created Medicare and Medicaid and passed the Clean Air Act and the Clean Water Act.

 

Republicans/Conservatives Accomplishments:

 

Republicans Voted against all of the above and have continued to this day to abolish the Programs or gut the Programs by cutting funding for which they have done and will continue to do.

 

Republican Supporters that are not Millionaires or Billionaires!

 

Republican Run Red States are some of the Poorest in the Nation; 45% of Children depend on Food Stamps; the Unemployment Insurance that expired December 2013 that the Republicans have refused to pass the extension Bill, hundreds of thousands of active and returning Veterans and the people that still can’t find work due to the unbelievable collapse of our Economy on George W. Bush’s Stewardship, are without the Unemployment Insurance and most of them are completely without any money to take care of their children.

 

Hence, it begs the question that whether you are Republican, Independent or Democrat and you if are not in the Millionaires or Billionaires Club, why do you support the GOP with your vote that enhances misery on you and your children?

 

Are you so blinded by being brainwashed or ignorance that you are unable to face reality? Or is it some other prejudice that possesses you body, soul and mind that causes you to suffer for the Republican Politicians that have and continues to protect only the very rich?

 

The Republicans just passed a Budget in the House of Representatives solely on GOP Party line that increases the Middle Class Taxes by $2,000.00, but, gives an additional $87,000.00 to the Rich. Just when you are going to face reality that your Greek god, Ronald Reagan idea of “trickled-down-economics is a farce that have scammed you and continue to scam you of having a better life for you and your children!
